A legal challenge against US sanctions 

Early in August, Joseph Kabila petitioned the American judiciary with the objective of being removed from the blacklist maintained by the Office of Foreign Assets Control (OFAC), the Treasury Department entity responsible for enforcing US economic sanctions. In a detailed sixteen-page legal complaint, his legal team disputes Washington’s decision, characterizing the accusations as lacking sufficient substantiation.

Allegations Joseph Kabila refutes 

US authorities have accused the former president of offering both financial and logistical assistance to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 group serves as its primary component. Washington further alleges that he encouraged Congolese military personnel to desert and that he resided in Goma, located in eastern RDC, under the protection of the M23. Joseph Kabila categorically denies these claims. His defense maintains that the evidence presented by the American administration is “vague” and “arbitrary,” failing to concretely establish the alleged transgressions.

The defense demands proof 

Attorneys representing the former president specifically highlight that the US dossier fails to identify any precise financial transfers directed to the AFC. They also assert that no specific Congolese military member is named as having been incited to desert by Joseph Kabila. Furthermore, his defense points out that in 2013, during his presidency, the Congolese army played a crucial role in the defeat of the M23.

A legal battle amidst eastern RDC crisis 

Joseph Kabila, who governed the RDC from 2001 to 2019, is now appealing to the federal court in Washington to lift the sanctions and remove his name from the OFAC list. This legal action unfolds against a backdrop where the M23 and the Alliance Fleuve Congo continue to be central to the ongoing conflict in eastern RDC, with diplomatic efforts persisting in an attempt to achieve a political and security resolution.
